O julgamento aconteceu no \u00faltimo dia 17 de mar\u00e7o, pela 8\u00aa C\u00e2mara Criminal do Tribunal de Justi\u00e7a de Minas Gerais (TJMG). O Desembargador relator do processo Anacleto Rodrigues absolveu os r\u00e9us &#8220;julgando improcedente a pretens\u00e3o punitiva (\u2026) nos termos do art. 386, inciso III, do CPP\u201d, escreveu aquele magistrado.<!--more--><\/p>\n<p style=\"text-align: justify;\">Beleza e Michel\u00e2ngelo foram condenados em primeira inst\u00e2ncia a oito anos de pris\u00e3o porque, conforme a den\u00fancia, &#8220;Beleza&#8221; recebia seu sal\u00e1rio de servidor da C\u00e2mara Municipal mas n\u00e3o cumpria o hor\u00e1rio de trabalho (ele foi nomeado diretor administrativo da C\u00e2mara Municipal de Cataguases). O caso ficou conhecido como \u201cfuncion\u00e1rio fantasma da C\u00e2mara\u201d. Contra Michel\u00e2ngelo, \u00e0 \u00e9poca presidente do Legislativo Municipal, pesava a acusa\u00e7\u00e3o de desvio de verba p\u00fablica. Ainda bem que existem Tribunais superiores para corre\u00e7\u00e3o de injusti\u00e7as\u201d, disse. \u201cO que temos que acabar \u00e9 com essas den\u00fancias irrespons\u00e1veis, mal intencionadas e lesivas \u00e0 moral de cidad\u00e3os de bem\u201d, completou. A defesa conta tamb\u00e9m com a atua\u00e7\u00e3o do advogado Ronaldo Dias.<\/p>\n<p style=\"text-align: justify;\">Em sua decis\u00e3o que absolveu os dois ex-vereadores de Cataguases, o relator Desembargador Anacleto Rodrigues afirma que ap\u00f3s fazer um \u201cexame do contexto f\u00e1tico&#8221; verificou-se que &#8220;o suposto conluio por parte dos acusados para desvio do dinheiro p\u00fablico n\u00e3o restou devidamente comprovado, vez que n\u00e3o h\u00e1 quaisquer ind\u00edcios de que o nomeante tenha sido beneficiado ou recebido parte do sal\u00e1rio do nomeado. Pelo contr\u00e1rio, as testemunhas ouvidas nos autos, quando indagadas, afirmaram n\u00e3o ter conhecimento de supostos ajustes neste sentido, tampouco verificaram acr\u00e9scimo financeiro e patrimonial desproporcional do nomeante\u201d, ressaltou o magistrado.
